These Terms and Conditions cover two MedNext products:

• Part A — MedNext Academy — the online medical education platform at www.mednext.academy
• Part B — MedNext Formulary — the clinical drug-reference mobile application

Part A — MedNext Academy Terms and Conditions

A.1 Acceptance of Terms

By accessing or using MedNext Academy at www.mednext.academy, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform. MedNext Academy is operated by MedNext Academy Private Limited, registered in India.

A.2 Description of Service

MedNext Academy is an online medical education platform designed primarily for students preparing for NEET UG, NEET PG, and related medical entrance examinations in India. The Platform provides:

• Structured course content across 19 medical subjects
• MCQ practice with AI-generated explanations
• Drug formulary reference
• Clinical resources and protocols
• Community forums
• Personalised study tools

A.3 Eligibility

The Platform is intended for:

• Students above the age of 16 preparing for medical entrance examinations
• Medical professionals seeking continuing education
• Institutions licensing the Platform for their students

Users under 18 years of age must have consent from a parent or guardian.

A.4 Account Registration

• You must provide accurate information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must not share your account with others. Accounts are for individual use only.
• Institutional Plan accounts may assign seats to individual users but may not allow simultaneous access by multiple users on a single seat.
• We reserve the right to suspend or terminate accounts found to be in violation of these terms.

A.5 Subscriptions and Payment

• Subscriptions are billed in Indian Rupees (INR).
• Payment is processed securely via Razorpay. MedNext Academy does not store your card details.
• Subscriptions renew automatically unless cancelled before the renewal date.

A.6 Refund Policy

Please refer to our Refund Policy for full details. In summary:

• Monthly plans: Eligible for a refund within 7 days of first purchase if the platform is not as described.
• Annual plans: Eligible for a pro-rated refund within 15 days of first purchase.
• No refunds are issued after the applicable period.

A.7 Content Accuracy and Medical Disclaimer

• Content is reviewed by qualified medical professionals and cross-referenced with standard textbooks and guidelines.
• Clinical protocols and drug dosing information must be verified against current national and local guidelines before clinical application.
• Medical information is updated regularly, but guidelines change. Always verify critical clinical information against the most recent authoritative source.

A.8 Intellectual Property

• All content on the Platform is the intellectual property of MedNext Academy and its content creators.
• You may not reproduce, distribute, resell, or share Platform content without prior written permission.
• Content may be downloaded for personal, offline study use only where the Platform explicitly provides a download feature.
• Screen recording, automated scraping, or any form of bulk content extraction is strictly prohibited.

A.9 Acceptable Use

You agree not to:

• Share your account credentials or allow others to access your account
• Reproduce or distribute Platform content commercially
• Use the Platform for any unlawful purpose
• Post inappropriate, offensive, or misleading content in the community forum
• Use automated tools to access or scrape the Platform

Violation of acceptable use policies may result in immediate account suspension without refund.

A.10 Privacy

Your use of the Platform is also governed by our Privacy Policy. By using MedNext Academy, you consent to the collection and use of data as described in the Privacy Policy.

A.11 Limitation of Liability

To the maximum extent permitted by applicable law, MedNext Academy shall not be liable for:

• Any indirect, incidental, or consequential damages arising from the use of or inability to use the Platform
• Errors or omissions in any content
• Any reliance placed on content for clinical decision-making

Our total liability shall not exceed the amount paid by you for the subscription in the month in which the issue arose.

A.12 Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of material changes via email or a notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated terms.

A.13 Governing Law

These Terms are governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of India.

Part B — MedNext Formulary Terms and Conditions

B.1 Agreement to Terms

By downloading, installing, creating an account, or using the MedNext Formulary application, you agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and MedNext Limited, a company registered in England and Wales.

B.2 Professional Use Only — Medical Disclaimer

This App must not be used to provide direct medical advice to patients. Always verify critical dosing and interaction information against current authoritative sources before making clinical decisions.

B.3 Eligibility

• Be 18 years of age or older
• Be a qualified or student healthcare professional registered with the appropriate regulatory body
• Have the legal authority to enter into a binding agreement
• Comply with all applicable laws and regulations in your jurisdiction

B.4 Account Registration

• To access most features, you must create an account with a valid email address.
• You are responsible for maintaining the confidentiality of your account credentials.
• Each account is for a single individual — do not share your credentials.
• We reserve the right to suspend or terminate your account without notice if you breach these Terms.

B.5 Subscription Plans and Payments

Payments and subscription management are handled by RevenueCat in conjunction with the Apple App Store or Google Play Store. Subscription tiers:

• Free (Trial): 7-day free trial of Ultimate features; auto-downgrades to Index Only after trial
• Pro: Full drug data, AI search, calculators, interaction checker — billed monthly via App Store / Play Store
• Ultimate: All Pro features + advanced AI, CME tracker, voice search, PDF reports — billed monthly via App Store / Play Store

Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Refund requests must be submitted directly to the Apple App Store or Google Play Store. MedNext cannot process refunds directly.

B.6 Acceptable Use

You agree not to:

• Use the App to dispense or prescribe drugs without proper clinical assessment
• Reverse-engineer, decompile, or attempt to extract source code or drug data from the App
• Share, sell, or sublicense your account or API access
• Use automated bots, scrapers, or scripts to access the App's data or API
• Misrepresent your professional qualifications when creating an account
• Resell or commercially redistribute App content without written authorisation from MedNext

B.7 Intellectual Property

All drug monographs, clinical data, software code, user interface design, trademarks, logos, and other content in the App are owned by or licensed to MedNext. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal professional use.

B.8 AI-Generated Content

The App includes AI-powered features. AI-generated content may be inaccurate, incomplete, or out of date. AI responses are intended to assist clinical thinking, not replace it. Do not make clinical decisions based solely on AI-generated content.

B.9 – B.10 Third-Party Services and Availability

The App integrates with Clerk (authentication), RevenueCat (subscriptions), Cloudflare (infrastructure), and Anthropic (AI). We aim to maintain the App's availability but cannot guarantee uninterrupted service. We may update, modify, suspend, or discontinue any feature at any time.

B.11 – B.13 Disclaimers, Liability, and Indemnification

The App and all content are provided “as is” and “as available” without any warranties. To the maximum extent permitted by applicable law, MedNext shall not be liable for any indirect, incidental, special, or consequential damages, including loss of life, patient harm, or loss of data. You agree to indemnify and hold harmless MedNext from claims arising from your use of the App in violation of these Terms.

B.14 Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

B.15 – B.16 Changes and Termination

We may modify these Terms at any time with notice via the App or by email. We may terminate or suspend your access immediately if you breach these Terms.
